TRP for Business Immigrants in Kazakhstan
A temporary residence permit (TRP) is a document that gives a foreign citizen the legal right to stay in Kazakhstan for up to 1 year. For business immigrants, this status is a prerequisite for registering their own company or buying a stake in a Kazakhstani LLP without any legal barriers.
Changes in legislation: what is now mandatory
Since 28 May 2024, new rules have been in force that significantly changed how foreigners can do business in Kazakhstan — including citizens of EAEU countries.
Under Clause 2 of Article 40 of the Law of the Republic of Kazakhstan “On Population Migration” (as amended on 16.05.2024), foreign citizens are prohibited from founding legal entities or becoming participants in the charter capital of commercial organizations without a visa or TRP with the status of “business immigrant”.
The exception is persons holding a residence permit (VNZh) and stateless persons holding the relevant certificate.
How the process works
Initial TRP for 90 days
The foreign citizen receives an initial temporary residence permit (TRP) in Kazakhstan for 90 days — the document is issued to the individual. During these 3 months the foreigner can register an LLP in Kazakhstan (or acquire a stake in an existing company).
Approval from the local executive body
After the LLP is registered, you need to obtain approval from the local executive body of the Republic of Kazakhstan responsible for entrepreneurship. Please note: the list of requirements for this approval may differ depending on the region.
TRP extension
With the executive body's approval and the registered LLP in hand, the documents for the TRP extension are filed on behalf of the legal entity (the operating LLP) — the extension period is 1 year. Filing is done through the CON.
For business immigrants, the TRP is issued for one year, with the possibility of extending it every year.
